Chester man loses suit for 47 days in jail for DUI

Police arrested Arturo Carlos Santiago of Chester for DUI in 2009 and held him when they thought they’d learned of warrants for his arrest in Washington, D.C., and Maryland.
The problem: The warrant from Maryland wasn’t for Santiago and the warrant from Washington. D.C., was later withdrawn. Maryland wanted a man named Jose Hernandez. Santiago, the man police had arrested in York County, later sued the county for wrongful incarceration. County officials argued that Santiago legally accepted the time he served in York County prison as his sentence for DUI, and U.S. Middle District Judge Sylvia Rambo agreed with them.

The moral of this story...when in jail, a plea may not be what you bargained for.

  1. Some courts will do anything to put you in jail, like send you a court date, but on error they send the wrong date, then lock you up for 30 days before learning it was a court error, The guy went to the court with the paper with the wqrong date on it and the court clerks would not check the guy in. So the court issued a warrent to arrest him for missing a court hearing falsely waisting tax dollars on a bad arrest. The guy did what he was suppose to do, just that he was sent the wrong court date in the mail, It was not his fault, but they blame him????

  2. I've said it before and I'll say it again, the Criminal Justice system is set up for criminals by criminals (so to speak) there is big money in incarcerating people, because prison owners are making a lot of money. You should see some of these prisons they are building, they look llike country clubs.....but when you make over 1,000 dollars per day per prisoner, then you have to get the bodies in the cells, and some court officials get kickbacks from helping to fill these prisons it's all business......that sucks for honest people because we are the ones it works on, because we are dumb enough to think the system still works!
